Other than Eating House license is a mandatory requirement FSSAI License for operating the food business in India such as restaurants, hotels, or any other eating place. The License shall be obtained at the time of opening the restaurant.

• Step 1

The city licensing police commissioner issues the Eating House license.

Obtaining the following license:

• Food License

  If you want to own a food business in India and get a food license from FSSAI. However, before applying for a license, make sure that you meet all the eligibility criteria for FSSAI registration.

• Health Trade License

  Food business units that trade in certain goods and services that directly affect the health of the general public in order to obtain a health trade license. The municipal corporation of the respective state issues Health Trade License.

• Eating House License

  The Commissioner of Police of the respective state has the authority to issue the Eating House license.

• Fire Security Certificate

  The food business operator should obtain a NOC from the fire department. Once the FBO has applied for the NOC, fire department officials will conduct an inspection.

• Liquor License

  The Excise Commissioner of the state will issue liquor license. Without this license, business operators cannot serve alcohol in their food business premises.

• Lift Clearance

  In the case of multi-story buildings, obtain an approval from the Electrical Inspector of the Office of the Labor Commissioner. The evacuation works as an assurance that the lift is operating according to safety standards.

• Music License

  Obtain a music license if music will also be part of food business.

• Environmental Clearance

  The pollution board of the concerned state will issue an environmental clearance certificate which ensures that the business will not harm the environment..

• Insurance

  It is necessary to take insurance for public liability, fire policy and company property.

• License under Shop and Establishment Act

  Obtain the license under Shop and Establishment Act from the concerned state. It is monitored by the Department of Labor that regulates premises wherein trade; business is performed.

• Weight & Measures Department Approval

  As per the Legal Metrology Act, 2009 it is compulsory for food business operators to get approvals of models of weighing & measuring instruments from the Weights & Measures Department.

Cancellation Process

The authority who has given the license can cancel or suspend the same based on:

• If the owner or license holder violates the guidelines issued while allotting the license or is found not to follow the instruction issued by the authority, the license can be canceled, if given a reasonable opportunity of being heard.
• If the eating house is not operating or is not ready to close its business for the stated reason, it can apply to the authority, for surrender of the license, which on receipt of such application, the license Will cancel.
